Officer O’Brien was investigating a minor accident, with his cruiser parked with the lights flashing. A vehicle travelling on the shoulder of the road struck him, killing him instantly.

On the evening of Tuesday, December 24, 1968, Officer Joseph E. O’Brien was working the 3:00 PM to 11:00 PM Cruiser shift, his regularly scheduled shift. At about 6:37 PM. The dispatcher received a report of a minor accident. Officer O’Brien was dispatched to the scene, and parked his cruiser with the lights flashing, and began to investigate the accident. A short time later, a vehicle travelling South on the roadway, on the shoulder of the road, struck Officer O’Brien and the operator of the vehicle involved in the original accident from the rear, killing both men instantly.
